05 / From court order to enforcement

An e-court payment order and the bailiff: we handle the process from start to finish

You do not have to work your way from a claim form to an enforcement application yourself. Instruct Saldora to handle the full route: we file in the e-court, handle payment order proceedings and, once an enforceable title is obtained, refer the case to the bailiff you nominate. You provide the documents, required authorisation and decisions; we handle the formalities.

  1. We file the claim
  2. The court considers the case
  3. Order and enforceability clause
  4. Application to the bailiff

1. You instruct us and we file the claim

We first establish who owes the money, the underlying transaction and the outstanding balance. You provide invoices, supporting records and payment history. After checking the procedure’s conditions, agreeing costs and obtaining the required authorisation, we handle filing. The creditor remains the claimant; Saldora arranges and manages case handling through an authorised person.

2. What does a court payment order mean?

A payment order is a court decision on the claim. It does not guarantee immediate payment or automatically authorise seizure of the debtor’s bank account. We monitor the outcome and case status to establish the appropriate next step.

3. When can the case go to a bailiff?

This route requires a final payment order with an enforceability clause: an enforceable title. The e-court grants the clause of its own motion after the order becomes final. We check the document and current balance, then handle the enforcement application. Once full payment is recorded, the same amount must not be pursued again.

4. You nominate the bailiff; we handle the referral

At the enforcement stage, you nominate the bailiff’s office. We check whether the case can be referred there and handle the application with the necessary information. Statutory limits apply to the choice: territorial jurisdiction, the type of enforcement and grounds for declining a case may matter. Not every case can go to any office in Poland.

Enforcement measures are carried out by the court bailiff. Saldora handles the referral; it does not replace the bailiff in seizing assets. New payments must be accounted for promptly so the enforcement amount reflects the actual debt.

5. What if the debtor objects?

A valid objection affects whether enforcement can proceed. In the e-court, proceedings are discontinued to the extent that the order has lost effect. We then discuss the next recovery route, required documents and the scope of handling outside that procedure with the creditor. A claim cannot be enforced without an effective enforceable title for that part.

6. How is the full process priced?

Amicable recovery includes the PDF demand. E-court handling has a separate fixed price based on the debt band and includes filing and payment order proceedings. Once an enforceable title is obtained, we handle referral to the nominated bailiff. Court fees, expenses and enforcement costs are separate; they are not a Saldora commission on recovered funds.

Before each stage starts, you know its scope and applicable fees. The court outcome and enforcement success depend on the case, including the debtor’s assets. Full service means handling the formalities, not a promise to recover every debt.
